Local Government Liable For Big Surf Injuries?

Good article in the O.C. Register on the issue of local government liability for injuries sustained in heavy surf.  The article focuses on two cases in Newport Beach, one of which involved a drowning while the other involved a broken neck.

Race exit in Solana Beach: This was one of three men practicing open water racing technique at Fletcher Cove in Solana Beach this morning. He may be a triathlete, or practicing for one of the lifeguard competitions, or something else entirely, but he sure seemed happy when he got back to the grassy area and got his wetsuit off before his friends did. Definitely a competitor.
