Upcoming Election: Proposition 90

Preserving property owner rights or expanding eminent domain law to the point where public development costs outweight prospective benefits.

One thing is clear: beach access and coastal development will be significantly changed if this measure passes.

Eminent domain has been a powerful tool in creating access to beach in the public trust, and the potential expansion of required compensation to include reimbursement of diminished value of nearby property owners (assuming a secluded residential neighborhood has higher property values than one with increased vehicle and pedestrian traffic) will impact government at all levels.
